1. Acceptance of Terms
By accessing or using any GoMedicai service — including our website at gomedicai.com and our dental practice automation platform ("Platform") — you agree to be bound by these Terms of Service ("Terms"). If you are acting on behalf of a dental practice or organization, you represent that you have authority to bind that organization.
If you do not agree to these Terms, do not access or use our services.
2. Description of Services
GoMedicai provides an AI-powered dental practice automation platform, including:
- 24/7 AI voice receptionist and omnichannel patient communication
- Real-time insurance eligibility verification and clearinghouse connectivity (EDI 270/271, 837D, 835, 277CA)
- Treatment plan financing comparison and patient handoff workflows
- Claims submission, status tracking, denial management, and remittance intake
- Automated patient balance follow-up and AR visibility
- Operational and revenue dashboards for practice administrators
GoMedicai is an automation overlay and does not serve as a system of record for clinical or financial data. Your Practice Management System (PMS) remains your system of record.
3. Eligibility and Account Registration
To use the Platform, you must:
- Be at least 18 years of age
- Be authorized to represent a licensed dental practice or DSO
- Provide accurate, complete registration information
- Execute a Business Associate Agreement (BAA) with GoMedicai prior to processing any Protected Health Information
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at security@gomedicai.com if you suspect unauthorized access.
4. Business Associate Agreement
Processing, transmitting, or storing Protected Health Information (PHI) through the Platform requires an executed BAA between your organization and GoMedicai. The BAA governs the handling of all PHI and supplements these Terms. In the event of a conflict between these Terms and the BAA regarding PHI, the BAA controls.
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of HIPAA or other applicable healthcare regulations
- Attempt to gain unauthorized access to any part of the Platform or its underlying infrastructure
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Upload or transmit malicious code, viruses, or disruptive data
- Use the Platform to harass, deceive, or harm patients or other users
- Resell or sublicense the Platform without written authorization from GoMedicai
6. Intellectual Property
All intellectual property in the Platform — including software, AI models, workflows, dashboards, and content — is owned by or licensed to GoMedicai. These Terms do not grant you any ownership rights. You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for your internal dental practice operations during the term of your subscription.
7. Data Ownership
You retain ownership of your practice data and patient data processed through the Platform. By using the Platform, you grant GoMedicai the right to process your data as necessary to provide the services, consistent with our BAA and Privacy Policy. GoMedicai does not use PHI to train AI models.
8. Subscription, Fees, and Payment
Subscription fees are charged according to the plan selected at sign-up. Fees are due in advance on a monthly or annual basis as selected. GoMedicai reserves the right to modify pricing with 30 days' written notice. Failure to pay may result in suspension or termination of access. All plans include a 30-day money-back guarantee as described at point of sale.
9. Uptime and Service Levels
GoMedicai targets 99.99% uptime. Planned maintenance will be communicated in advance. Service level commitments are detailed in your subscription agreement. Real-time status is available at status.gomedicai.com.
10. Termination
Either party may terminate the subscription with written notice per the terms of your subscription agreement. Upon termination, your access to the Platform will cease. You may request a data export within 30 days of termination. GoMedicai reserves the right to suspend or terminate accounts for violations of these Terms without prior notice.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." GOMEDICAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOMEDICAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, PROFITS, OR DATA, ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO GOMEDICAI IN THE THREE MONTHS PRECEDING THE CLAIM.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Hillsborough County, Florida.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-platform notice at least 14 days before taking effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
